Compu Devices, Inc. does not provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness, or suitability of the information and materials found or offered on the Site for any particular purpose.
Compu Devices, Inc. is not liable for any damages or injury that result from your use of the Site. This includes but is not limited to, damages or injury caused by any failure of performance, error, omission, interruption, defect, delay in operation, computer virus, or line failure.
All products and services available on the Site are provided "as is" without any warranty whatsoever, either express or implied. Compu Devices, Inc. disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Indemnification
You agree to indemnify, defend and hold harmless Compu Devices, Inc. its officers, directors, employees, agents, licensors, suppliers, and any third-party information providers to the Site from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of this Agreement (including negligent or wrongful conduct) by you or any other person accessing the Site.
Limitation of Liability
Compu Devices, Inc. or any party involved in creating, producing, or delivering the Site shall not be liable for any direct, incidental, consequential, indirect, or punitive damages, or any other losses, costs, or expenses of any kind (including legal fees, expert fees, or other disbursements) which may arise, directly or indirectly, from your use of the Site, including but not limited to anything caused by:
- Any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft, or destruction, or unauthorized access to, alteration of, or use of information or materials.
- Any act or decision made by you in reliance on the information or materials contained on the Site, or any action or inaction on the part of Compu Devices, Inc.
- Your failure to comply with the TCUS or from any communication on the internet, or from any unauthorized access to, or alteration of, your data transmissions, not limited to negligent acts and/or omissions of Compu Devices, Inc.
Your sole and exclusive remedy for dissatisfaction with the Site and any damage resulting from the use of the Site is to stop using the Site. This limitation of relief is a part of the agreement between the parties.
This limitation of liability applies to all claims for damages, no matter what the legal grounds may be, including but not limited to actions in contract, tort, and strict liability claims. Some jurisdictions do not allow for the limitation or exclusion of liability for incidental or consequential damages; as a result, the above limitation or exclusion may not apply to you.

Severability
If any provision of these TCUS is held by a court of competent jurisdiction to be contrary to law, such provision shall be changed and interpreted so as to best accomplish the objectives of the original provision to the fullest extent allowed by law, and the remaining provisions of these TCUS will remain in full force and effect.
Force Majeure
Compu Devices, Inc. shall not be held responsible for any delay or failure in the performance of any part of this agreement to the extent such delay or failure is caused by fire, flood, explosion, war, strike, embargo, government requirement, civil or military authority, an act of God, or other similar causes beyond its control and without the fault or negligence of Compu Devices, Inc.
Entire Agreement
These TCUS constitute the entire agreement between you and Compu Devices, Inc. with respect to the Site and supersede all prior or contemporaneous communications, agreements, and proposals, whether electronic, oral, or written, between you and Compu Devices, Inc with respect to the Site.
